Kano APC Ward Executives Barred from Dismissing Ganduje by Court Order
A Federal High Court in Kano, under the direction of Justice A. M Liman, has issued an order prohibiting the self-proclaimed executive members of the All Progressives Congress (APC) in Ganduje Ward from suspending Abdullahi Ganduje, the national chairman of the party. This order will remain in effect until the court hears and decides on a lawsuit filed by the former governor to uphold his fundamental rights.
Ganduje, represented by Barrister Hadiza Nasir Ahmed, petitioned the court to defend his rights to fair hearing and freedom of association, as outlined in the Enforcement and Procedure Rules, 2009, within Section 46 of the Constitution of the Federal Republic of Nigeria, 1999 as amended.
The injunction was issued after a hearing on an ex parte application made by Ganduje’s legal counsel.
Furthermore, the judge instructed all involved parties to maintain the existing state of affairs before the alleged emergency meeting of the APC Ganduje Ward’s executive members and to refrain from any actions related to the matter until a motion on notice is heard and decided.
“All parties, their representatives, agents, or associates are hereby prohibited from carrying out or enforcing any decisions made during the alleged Emergency Meeting of the purported Executive Members of APC Ganduje Ward on April 20, 2024, until the court deliberates on the application for the enforcement of the applicant’s fundamental rights,” ruled the judge.
The respondents named in the case include Basiru Nuhu Isah, the Nigeria Police Force, the Commissioner of Police of Kano Command, the Inspector General of Police, and the Department of State Services.
A hearing for the case has been scheduled for May 9, 2024.
